Acceptable Use Policy

This Acceptable Use Policy (“AUP”) governs your use of the Faceless Inc. (“Faceless”, “we”, “us” or “our”) website, applications, and services (the “Service”). It supplements, and is incorporated into, our Terms of Use. Capitalized terms not defined here have the meaning given in the Terms of Use. If you violate this AUP, we may remove content, suspend or terminate your account, and, where appropriate, report the activity to law enforcement.

1. What Faceless is for. Faceless is a creative software tool that generates images of a fictional, computer-generated persona you create from reference photos you are entitled to use. It is intended for lawful marketing, branding, portfolio, and personal-creative purposes. It is not a service for adult content, for depicting real identifiable people, or for any of the prohibited uses below.

2. Reference photos — rights and consent. You may upload reference photos only if you own them or have all necessary rights and permissions. You must have the explicit consent of any person whose face or likeness appears in a reference photo. You may not upload or use an image of another person without that person’s permission or a sufficient legal right to do so. We do not retain the reference photos you upload after they have been used to create your persona.

3. Prohibited content and conduct. You may not use the Service to create, upload, generate, store, or distribute any content, or to engage in any conduct, that:

• is sexual or adult in nature — including nudity, sexually explicit or suggestive imagery, pornography, or any content created for the purpose of sexual gratification;
• depicts, sexualizes, or endangers minors in any way, or portrays any person who is or appears to be a minor in an inappropriate, lewd, or objectionable manner;
• depicts a real, identifiable person without their consent — including “deepfakes,” face-swaps, or any synthetic likeness of a real individual (such as a public figure or celebrity) — or that impersonates any person or entity;
• is intended to deceive or defraud, including creating fake identities or synthetic media to mislead others, spread misinformation, or facilitate scams;
• infringes the intellectual-property, privacy, publicity, biometric, or other rights of any person or entity;
• is unlawful, threatening, abusive, harassing, defamatory, invasive of privacy, hateful, or that promotes violence, self-harm, terrorism, or discrimination;
• violates any applicable local, national, or international law or regulation, or is used in any jurisdiction where the Service or such content is prohibited;
• attempts to bypass, disable, or interfere with our content-moderation, security, or rate-limiting measures, or otherwise misuses the Service as described in the Terms of Use.

4. Your responsibility for outputs. You are solely responsible for the images you generate and how you use them, including compliance with applicable law and third-party rights. Generated images are of fictional personas; you must not present them as depicting a real person, and you must comply with any applicable disclosure rules for AI-generated media.

5. Monitoring, moderation, and enforcement. We may — but are not obligated to — monitor, screen, and moderate content and generation requests, including automated filtering that blocks content flagged as unsafe. We reserve the right, in our sole discretion, to remove or refuse to process any content, to suspend or terminate accounts that violate this AUP, and to disclose information and cooperate with law enforcement where we believe unlawful activity has occurred, as described in the Terms of Use.

6. Your account and data. You can cancel and delete your account at any time from your account settings. Deleting your account removes your personas, generated images, and associated personal data from our systems. As noted above, we do not retain the reference photos you upload after they have been used to create your persona. How we handle your information is described in our Privacy Policy.

7. Reporting. To report content or conduct that you believe violates this AUP, contact us at [email protected].

8. Changes to this policy. We may update this AUP from time to time. When we do, we will revise the “Effective as of” date above. Your continued use of the Service after a change takes effect constitutes acceptance of the updated policy.
